Yes. Regulation (EC) No 1223/2009 governs the product placed on the market, not where it is made. A cosmetic made in Morocco can be sold in France if it has a Responsible Person in the EU, a PIF, a safety assessment and a CPNP notification. See our guide to exporting to Europe.
Who is the Responsible Person?
It is your company if it is established in the European Union, or your importer, or a representative appointed in writing. We provide them with the complete Product Information File.
Are there customs duties between Morocco and France?
Since 2012, industrial products of Moroccan origin have entered the European Union free of customs duties under the EU–Morocco Association Agreement, with an EUR.1 certificate of origin.
